Washington just approved a landmark 30-year civil nuclear agreement with Saudi Arabia. On paper, it looks like a massive commercial win for American energy giants like Westinghouse, promising tens of billions of dollars in nuclear infrastructure projects. Below the surface, it represents one of the biggest foreign policy shifts in recent memory.

Missing Safeguards and the Enrichment Exemption
For decades, the standard for American nuclear cooperation agreements under Section 123 of the U.S. Atomic Energy Act involved strict guardrails. Traditionally, the U.S. demanded the "gold standard" non-proliferation clause: partner nations must explicitly renounce domestic uranium enrichment and spent fuel reprocessing. The United Arab Emirates agreed to these terms back in 2009.
This new deal bypasses that standard completely.
Instead of prohibiting uranium enrichment, the agreement creates a clear legal pathway for a joint U.S.-Saudi study over the next two years to build an enrichment facility inside the Kingdom. While Washington points out that any future enrichment facility would be run by American firms using U.S.-controlled technology rather than handed directly to Saudi operators, the omission of explicit non-proliferation bans is raising alarm bells across Capitol Hill.
To make matters more tense, the White House had to issue a special national security waiver because the deal doesn't mandate the International Atomic Energy Agency's (IAEA) Additional Protocol—the mechanism that allows inspectors unannounced access to facilities.

Why is Riyadh pushing so hard for domestic nuclear power right now?
It comes down to simple economics and future proofing. Right now, Saudi Arabia burns massive amounts of its own crude oil and natural gas just to keep its domestic power grid running. Roughly 32% of their electricity comes directly from burning oil, while natural gas accounts for the rest. Every barrel of crude burned domestically to power air conditioners and water desalination plants is a barrel that can't be sold on global markets.

On top of that, Saudi Arabia is pivoting toward becoming a major tech and AI hub. Running massive AI data center infrastructure takes immense, uninterrupted baseload power. Wind and solar help, but they don't provide the steady, 24/7 gigawatts required to keep thousands of high-density server racks online. Nuclear energy gives them clean, continuous baseload power, freeing up their valuable oil reserves for export while powering their tech ambitions.
The Geopolitical Chess Board
From the White House perspective, saying "no" to Riyadh wasn't going to stop Saudi Arabia's nuclear ambitions. It simply would have driven them into the arms of Beijing or Moscow. China and Russia have been actively bidding for nuclear contracts across the Middle East with zero non-proliferation requirements attached.
By anchoring Saudi Arabia’s nuclear infrastructure to American firms, Washington keeps a tight, long-term grip on the Kingdom's supply chains and energy sector for the next three decades.
Yet, the timing couldn't be more delicate. The U.S. has maintained a firm policy against Iranian domestic uranium enrichment, making the allowance of a potential enrichment pathway for Saudi Arabia look like an obvious double standard to critics. It also uncouples nuclear cooperation from the long-sought diplomatic normalization between Saudi Arabia and Israel, separating two tracks that diplomats previously insisted had to go hand in hand.
What Happens Next in Congress
Now that the administration has signed off on the agreement, the clock starts ticking. Under U.S. law, Congress gets a 90-day review period to evaluate the 123 Agreement.
Expect fierce bipartisan debate over the coming weeks. Lawmakers on both sides of the aisle are already preparing to question officials over the lack of IAEA Additional Protocol safeguards and the precedent this sets for future non-proliferation policy.
However, blocking the deal isn't easy. Opponents in Congress would need to pass a joint resolution of disapproval with a veto-proof two-thirds majority in both houses—a hurdle that remains exceptionally high.
